Legal Services
DTS Building Consultants can provide expert building reports as a part of the litigation support process for matters, which are before the Tribunals and courts, Such as the NSW Civil and Administrative Tribunal (NCAT) in New South Wales and the Consumer Trader and Tenancy Tribunal (CTTT) in NSW.
When complete these reports cover building defects, which can be claimed against a building contractor. These defects are many and varied and can include sub-standard work, dampness, termite damage, excessive deflections and cracking within a building, leaking showers and subsidence just to name a few. We can also provide this service to the building contractor where an unreasonable building claim is lodged against them or their company in the Tribunal.
All defects must be substantiated using the Building Code of Australia, as well as various Australian Standards, which cover the construction of the building.
The Tribunal and Courts require reports to be completed in a detailed format so that the actual defect can be substantiated or assessed. The claims before the Court or Tribunal can be either a single item or multiple defects.
Apart from the Building Code of Australia and various Australian Standards, other product documents such as manufacturer’s specifications can also be referenced in these reports and during the proceedings.
DTS Building Consultants have experience in dealing with such matters and their inspectors have appeared previous cases before both QCAT and the CTTT.
